By accessing or using MixCreate, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use our services.

2. Description of Service

MixCreate provides a collaborative audio platform that allows users to upload, mix, and share audio stems and projects ("Service"). We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

To access certain features, you must create an account. You represent and warrant that all information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. User Content

You retain all rights and ownership of the audio files, images, and other content ("User Content") you upload to MixCreate.

By uploading User Content, you grant MixCreate a worldwide, non-exclusive, royalty-free license to use, store, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content solely for the purpose of operating, developing, providing, and improving the Service.

You represent and warrant that:

You own or have the necessary licenses, rights, consents, and permissions to your User Content.
Your User Content does not infringe upon the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights.

5. Copyright & DMCA

We respect the intellectual property rights of others. We will respond to notices of alleged copyright infringement that comply with applicable law. If you believe your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information in accordance with the Digital Millennium Copyright Act (DMCA).

6. Prohibited Conduct

You agree not to use the Service to:

Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or promoting hatred.
Violate any applicable law or regulation.
Interfere with or disrupt the security or performance of the Service.
Attempt to reverse engineer or access non-public areas of the Service.

7. Payment & Subscriptions

Certain features of the Service may require payment. All fees are non-refundable unless otherwise stated. We reserve the right to change our pricing at any time. Recurring subscriptions will automatically renew unless canceled.

8. Limitation of Liability

To the fullest extent permitted by law, MixCreate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MixCreate operates, without regard to its conflict of law provisions.

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. You are advised to review these Terms periodically for any changes.
